Disclaimer Policy for Amsterdam Genetics (Masque B.V)
Section 1 – Purchaser shall not make available, deliver, prepare, treat, process, offer for sale, sell, provide, transport, manufacture, or have available the products deliverable by Masque B.V., if purchaser is aware or has serious reason to suspect that such products deliverable are intended to commit any of the criminal offences as deemed punishable under the Dutch Opium Act, article 11a in conjunction with paragraphs 3 and 5 of article 11; and furthermore article 1 paragraph 2, involving either the occupational, commercial, large-scale, or professional cultivation of hemp as intended in these aforementioned articles.
Section 2 – Purchaser is aware that any deliveries of products and services by Masque B.V. to any purchaser involved in the commercial, large-scale cultivation and/or organised cultivation of hemp, or their facilitation, as mentioned above, could potentially result in suspicions towards Masque B.V. on account of engaging in illegal activities as intended by Dutch Opium Act article 11a in conjunction with paragraphs 3 and 5 of article 11.
Section 3 – In the context of the legal obligation pertaining both to Masque B.V. and the purchaser to take precautions preventing Masque B.V. from committing violations of Dutch Opium Act article 11, purchaser, upon placing their order at Masque B.V., shall declare that none of the products ordered are intended to be used, made available, delivered, prepared, treated, processed, offered for sale, sold, provided, transported, or manufactured on behalf of or related to large-scale or professional hemp cultivation.
Section 4 – If purchaser acts in breach of the stipulations provided in section 1 of the present policy, Masque B.V. shall immediately dissolve the purchase agreement and proceed to non- delivery. In such events, all business agreements with the purchaser involved shall be terminated immediately. In such events, Masque B.V. is entitled to charge any damages, including any loss of profit, to purchaser. In no such instances shall purchaser be entitled to any compensation of damages whatsoever.
Section 5 – If purchaser utilises the products or services orderable from Masque B.V. in breach of the present agreement and/or of the Dutch Opium Act for purposes of large-scale or professional hemp cultivation; or if purchaser makes available delivered products or services in any of the manners as intended by section 1 of the present article, purchaser shall be liable for any damages incurred by Masque B.V. resulting from any criminal investigations and or criminal persecutions; as well as for any administrative measures implemented against Masque B.V. and/or its employees.
Section 6 – Damage is interpreted as including any and all direct or indirect damage, material and immaterial damage, trading loss, consequential damage and any other loss or damage to be incurred by Masque B.V. resulting from criminal investigations and/or criminal persecution and/or administrative measures. Such loss and damage furthermore but not exclusively includes loss of profit, legal assistance expenses and other consultation expenses, reputational damage, loss of goods, material damage, and immaterial damage.
